1. Introduction

Welcome to Flok. These Terms and Conditions govern your use of the Flok platform, located at www.flok.ch, which connects parents with providers of children's activities in Geneva, Switzerland. By accessing or using our platform, you agree to be bound by these terms.

2. Acceptance of Terms

By creating an account, making a booking, or using any service provided by Flok, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our platform.

3. Description of Service

Flok is an online marketplace that allows parents to discover, book, and pay for children's activities offered by third-party providers. We act as an intermediary between parents and activity providers. We do not organize or run activities ourselves.

4. User Accounts

To use our platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account. You agree to provide accurate and complete information and to update your information as needed.

5. Activity Providers

Providers are independent third parties who offer activities through our platform. Providers are responsible for the quality, safety, and legality of their activities. Flok does not guarantee the accuracy of provider listings or the quality of services provided. Providers must comply with all applicable Swiss laws and regulations.

6. Bookings and Payments

When you book an activity, you agree to pay the specified price plus any applicable fees. Payments are processed securely through our platform. Flok charges a 6% transaction fee on each booking, which includes a 3% Stripe processing fee. Bookings are confirmed subject to availability.

7. Cancellation and Refunds

Cancellation policies vary by provider. Please review the specific cancellation policy before booking. Generally, cancellations made 48+ hours before the activity may be eligible for a full refund. Cancellations made less than 48 hours before may not be eligible for refunds. Refunds are processed within 5-10 business days.

8. Liability

Flok acts as an intermediary and is not liable for any damages, injuries, or losses arising from activities booked through our platform. Providers are responsible for ensuring the safety of their activities. Parents should supervise their children appropriately. Flok's liability is limited to the maximum extent permitted by Swiss law.

9. Intellectual Property

All content on the Flok platform, including logos, designs, text, and software, is protected by intellectual property rights. You may not copy, reproduce, or distribute any content without our prior written consent.

10. Privacy

We collect and process personal data in accordance with the Swiss Federal Act on Data Protection (FADP). By using our platform, you consent to the processing of your personal data as described in our Privacy Policy.

11. Governing Law

These Terms and Conditions are governed by Swiss law. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.

12. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page. Your continued use of the platform after changes constitutes acceptance of the new terms.
